Terms of Service for Baptist WebSite
1. You agree to use the service for your Church or
Christian Ministry.
2. You agree that Sub Domains are directly part of
your church ministry and not an effort to by pass registration
or hosting for another ministry.
3. You agree that all uploads are from your church
ministry and not archives of sermons or music of other sources.
All music or sermons must originate from your ministry. This
would include any regular or special services. If it was held in
your church and legally recorded then you may include them on
your site.
4. No copyrighted material may be uploaded unless
YOU hold the rights to the copyright itself.
If you make copies of copyrighted music recordings without
the copyright holder’s permission, you are stealing music and
that’s against the law.

5. UNLIMITED USE POLICY
High bandwidth and disk usage: Baptist WebSite offers an
unlimited use policy. This is defined as no predetermined
limits. In rare cases, Baptist WebSite may find a customer
to be using server resources to such an extent that they may jeopardize server performance and resources for other
customers. In such instances, Baptist WebSite reserves the right
to impose restriction or denial of services for the
consideration of all customers. This applies to bandwidth and
disk storage.
Baptist WebSite may implement the following policy to at its
sole discretion:
When a website is found to be monopolizing the resources
available, Baptist WebSite reserves the right to suspend that
site immediately. This policy is only implemented in extreme
circumstances and is intended to prevent the misuse of our
servers.
All disk space is allocated dynamically. That is it is
increased as needed. Please note that when you reach about 80%
of your current limit you will receive a notice to contact me.
Just E-mail me a note telling me you received that message and I
will then give you more access. This is just a way for me to
control the flow of sites and avoid a hacker from "stealing" the
entire disk at once.
Generally, limited Web Casting is allowed. However, if in our
opinion the use of such Web Casting causes undue use of the
system resources, we reserve the right to deny such services.
Internet radio services streaming from your site are not
allowed.
6. FLAT RATE PRICE GUARANTEE
Baptist WebSite guarantees for as long as you are a
continuous client, in good financial standing, and you keep
renewing your account for web hosting service, we guarantee and
promise that you will be locked into paying your current web
hosting prices forever.
7. DOMAIN NAMES
When a user signs up for a Domain Name through Baptist
WebSite, it is registered in YOUR name and under YOUR ownership.
You are free to register a Domain Name with any ICCAN authority
and have it pointed to Baptist WebSite at no cost from us. We
do not bulk register your Domain Name, as some others do. This
means you have full rights to the your Domain Name. This
means that you will see your details as the current domain name
owner and not our information.
Domain Registration
This section applies to those domain names we have purchased
on behalf of clients
Fees
As consideration for the domain name registration services
provided by Baptist WebSite. You will be notified (by email
only) when renewal fees are due. Notices are sent out 60, 45,30
and 15 day intervals. It is your responsibility to ensure that
such fees are paid. If you do not respond or pay within the
specified time period for registrations the Domain Name may be
lost or a fee imposed to regain the name again.
8. 30 DAY MONEY BACK GURRENATEE
If you sign up for a hosting account and for any reason are
not happy we will refund your money in full if you cancel within
30 days. The refund is not extended to the Domain Names, but you
will retain ownership of the Domain Name.
9. CANCELLATION AND REFUNDS
Baptist WebSite reserves the right to cancel any account at
any time. In this event customers will be entitled to a pro rated
refund based upon the remaining unused time. Customers are not
entitled to receive a refund if the terms of service are
violated.
10. BILLING
You agree that you will keep up with your payments having the
funds available when your card is billed for your next term.
Please keep your contact information current. You will be
notified at 60, 45, 30 and 15 day intervals. There is also an
option to have auto recurring payments charged to your credit
card when either the Domain Name of Hosting is due.
You agree that you will pay the amount indicated (whether by
check or by credit card) on time or we will be forced to suspend
and eventually delete your domain from our system. Non-payment
for hosting will not necessarily end up with a domain name
deletion, since you own it. The Domain Name will be lost once
the time for its payment is expired and has not been renewed.
You may chose to cancel your hosting account yet keep your
Domain Name active. You will normally get billed yearly
according to the anniversary date of signing up. If you are
having trouble paying your bill, please let us know. Please
don't just stop corresponding with us. I am sure that we can
work something out! We are here to help and serve you.
Remember this is a Ministry and NOT a business so we want to
help if we can. Hard times fall on us all but working together
we can keep the light shinning.
Accepted Payment Methods include Visa, MasterCard, American
Express, Discover, Pay Pal, Money Orders and Checks drawn on US banks.
(Please note: a $50.00 charge applies to returned checks due to
insufficient funds)
Remember, you will always be billed on the anniversary date
of your hosting and Domain Name registration...Please note that
by not cancelling before your auto billing date, you are agreeing
that it is ok to charge your card at that time. This applies
only to those on Auto-Renewal.
11. OVER DUE ACCOUNTS
1. Accounts that are past due will be subject to suspension.
2. Accounts for which payment is not remitted 90 days past
suspension will be deleted from our servers. If the Domain Name
has expired and has gone beyond the redemption period then the
hosting account will be terminated, even if within the 90 past
due date. However, It will not necessarily be deleted from our
severs at that time.
4. In the event a customer requires files from a deleted
account, a $100 backup fee will apply if a suitable backup can
be found. There is no guarantee that a suitable backup will be
found after an account has been deleted. Customers are
encouraged to keep current backups on their systems. The server
allows for unlimited backup to your local machine at no cost.
12. SITE CONTENTS
We do not host, support or promote any ministry, business or
service that contradicts the ministry and Gospel of Jesus
Christ. . If we find your site contradicts this, we will remove
the site from our servers without notice and without refund.
No
exceptions
You agree that your site will not have anything on it that
contradicts that:
A-The Bible is the only authoritative Word of God
B-The only means of being saved from sin’s condemnation is
through repentance and faith in the precious blood of Jesus
Christ, which is essential for personal salvation. Any system of
works is not compatible with the purpose of this ministry.
C- Your site must not deny the literal death, burial and
resurrection of Jesus Christ.
All services provided by Baptist WebSite may be used for
lawful purposes only. Transmission, storage, or presentation of
any information, data or material in violation of any United
States Federal, State or City law is prohibited. This includes,
but is not limited to: copyrighted material, trademark,
intellectual property, material we judge to be threatening or
obscene, or material protected by trade secret and other statute
without proper authorization. The subscriber agrees to indemnify
and hold harmless Baptist WebSite from any claims resulting from
the use of the service which damages the subscriber or any other
party.
Pornography and sex-related merchandising and material is
prohibited on all sites hosted by Baptist WebSite. This includes
sites that may infer sexual content, or links to adult content
elsewhere. If you host non-adult related content with us and
then host adult related sites somewhere else, this is also
prohibited and we can not allow someone to host on our servers
that would host pornography elsewhere. If we find out that you
are hosting adult material elsewhere, we will be forced to
remove your site (even if it does not have adult material on it)
from our servers because we will not help in any shape or form
someone walking is such a manor. We will be the sole arbiter in
determining violations of this provision.
If pornography is found on our server, the offending domain
will be deleted immediately with no warning and no refunds of
money will be given. NO links to any pornography or sex related
sites are tolerated and your site will immediately be removed
without refund.
Also prohibited are sites that promote any illegal activity
or present content that may be damaging to Baptist WebSite
servers or any other server on the internet. Links to such
materials are also prohibited. No warez, illegal MP3 downloads,
top list or gaming sites.

Top Sites
Baptist WebSite will be the sole arbiter as to what
constitutes a violation of this provision.
Your site cannot promote demonic, occult, satanic, new age or
anti-Christian values or beliefs; cannot promote pro-choice or
pro-abortion views; cannot promote gay or lesbian lifestyle
views; cannot promote a distorted view or faulty interpretation
of the Holy Bible. There is to be no misconstruing of God's
Word. Not only can you not have offending material on your
sites, but you cannot have links to any sites with offending
material on them or material listed above.
Also there can be no Anti-American material in content, or
links on your site. Any hatred of freedom or liberty will not
tolerated. Controversial political view are fine but nothing to
undermine the base core of American values will be tolerated.
Baptist WebSite will be the sole arbiter as to what constitutes
a violation of these provisions.
If links to any offending sites are found, we will ask you to
remove them and if you do not comply, we will then have to
remove your account from our server and no refunds issued. The above
listing is not complete by any means.
Baptist WebSite decides
what is offending to our Web Site family and we want everyone to
abide by those rules. Baptist WebSite has the complete right to
ask anyone to leave for any offending reason at our discretion.
At Baptist WebSite’s discretion, access to Baptist WebSite's
server (and your account) may be revoked at any time for abusive
conduct on the system and / or the Internet and its resources as
a whole.
13. E-Mail
Spamming, or the sending of unsolicited e-mail or message
board posts including, without limitation, commercial
advertising and informational announcements, from our server(s)
or using an e-mail address or domain that is maintained on a
Baptist WebSite machine as reference in that spam is STRICTLY
prohibited. Domains and sites are subject to being canceled
immediately off of our server as well as fined no less than $500
USD. A user shall not use another site's mail server to relay
mail without the express permission of the site. Baptist WebSite
will be the sole arbiter as to what constitutes a violation of
these provisions.
14 . System and Network Security
Violations of the Baptist WebSite system or network security
are prohibited, and may result in criminal and civil liability.
Baptist WebSite will investigate incidents involving such
violations and may involve and will cooperate with law
enforcement if a criminal violation is suspected. We reserve the
right to investigate files in a customer's account at any time
if we have any reason to suspect there may be activities or
network security violations including, but not limited to:
A. Unauthorized access to or use of data, systems or
networks, including any attempt to probe, scan or test the
vulnerability of a system or network or to breach security or
authentication measures without express authorization of the
owner of the system or network.
B. Unauthorized monitoring of data or traffic on any system
or network without express authorization of the owner of the
system or network.
C. Interference with service to any user including, but not
limited to, mail bombing, flooding, deliberate attempts to
overload a system and broadcast attacks.
D. Forging of any TCP-IP packet header or any part of the
header information in an e-mail or a newsgroup posting. Baptist
WebSite reserves the right to report illegal activities to any
and all regulatory, administrative, and / or governmental
authorities for prosecution.
15. IRC
We currently do not allow IRC or IRC bots to be operated on
our servers.
16. Age
The client must be 18 years of age to obtain our hosting
services.
17. Newsgroups
We do not allow Newsgroups at this time on the server.
18. Indemnity
You agree to defend, indemnify and hold harmless Baptist
WebSite for any loss, damages or costs, including reasonable
attorneys' fees, resulting from any third party claim, action,
or demand related to your domain name or the use thereof. This
indemnification is in addition to any indemnification required
under the Dispute Policy. We do not own your domain name nor do
we want to and we do not claim ownership of your content. It is
completely yours. All content on your web site is considered a
publication of yours and we are not to be held responsible for
anything you present on the web through your domain in any way.
19. Limitation of Liability for Domain Registration
YOU AGREE THAT Baptist WebSite WILL NOT BE LIABLE TO YOU OR
ANY OTHER PERSON FOR ANY LOSS THAT MAY OCCUR DUE TO
(a) ANY LOSS OF REGISTRATION OF A DOMAIN NAME,
(b) THE USE OF YOUR DOMAIN NAME,
(c) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO Baptist WebSite
/DOMAIN REGISTRATION SYSTEM;
(d) THE NON-DELIVERY OR MISDELIVERY OF DATA BETWEEN YOU AND
Baptist WebSite;
(e) EVENTS BEYOND Baptist WebSite's CONTROL;
(f) THE PROCESSING OF THIS APPLICATION;
(g) THE PROCESSING OF ANY MODIFICATION TO THE RECORD
ASSOCIATED WITH YOUR DOMAIN NAME,
(h) THE FAILURE OF YOU OR YOUR AGENT TO PAY ANY FEES
HEREUNDER; OR
(i) THE APPLICATION OF THE DISPUTE POLICY. FURTHER, Baptist
WebSite OR Domain Registration services WILL NOT BE LIABLE FOR
ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF
ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF
ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR
OTHERWISE, EVEN IF Baptist WebSite HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL Baptist
WebSites’s MAXIMUM LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU
TO Baptist WebSite. FOR REGISTRATION OF YOUR DOMAIN NAME DURING
THE PRIOR 3 YEARS. TO THE EXTENT APPLICABLE STATE DOES NOT ALLOW
THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL
DAMAGES, OUR LIABILITY IS LIMITED TO THE MINIMUM EXTENT
PERMITTED BY LAW
20. Limitation of Liability for Hosting
Baptist WebSite shall not be responsible for any claimed
damages, including incidental and consequential damages, which
may arise from Baptist WebSite.'s servers going off-line or
being unavailable for any reason whatsoever. Further, Baptist
WebSite shall not be responsible for any claimed damages,
including incidental or consequential damages, resulting from
the corruption or deletion of any web site from one of Baptist
WebSite's servers. All damages shall be limited to the immediate
termination of your service. Baptist WebSite will not be held
responsible for any problems that a reseller's customer may
have. We will always do our best to keep things running smoothly
and to ensure that your web experience is the best. We disclaim
any and all loss or liability resulting from, but not limited
to:
(1) loss or liability resulting from access delays or access
interruptions;
(2) loss or liability resulting from data non-delivery or
data miss-delivery;
(3) loss or liability resulting from acts of God;
(4) loss or liability resulting from the unauthorized use or
misuse of your Account Number, Password or security
authentication;
(5) loss or liability resulting from errors, omissions, or
misstatements in any and all information or service(s) provided
under this agreement;
(6) loss or liability relating to the deletion of or failure
to store e-mail messages;
(7) loss or liability resulting from the development or
interruption of your Web site;
(8) loss or liability from your inability to use our mail
service; or
(9) loss or liability from the use of our mail service; or
(10) loss or liability that you may incur in connection with
our processing of your application for our services, our
processing of any authorized modification to your domain name
record or your agents failure to pay any fees, including the
initial registration fee or re-registration fee.
21. Refusal of Service
Baptist WebSite shall be the sole arbiter of what is and is
not a violation of these acceptable use policies. Baptist
WebSite reserves the right to terminate any account at any time
and for any reason. Baptist WebSite reserves the right to delete
all content and files upon termination. Baptist WebSite reserves
the right to withhold any pre-paid funds for any site removed
for violations of these policies. Baptist WebSite reserves the
right to refuse, cancel, or suspend service at our sole
discretion.
In the event that any provision of this Agreement is deemed
unenforceable or invalid, such unenforceability or invalidity
shall not affect the remainder of this Agreement. Baptist
WebSite may amend or replace such provision with one that is
valid and enforceable and which achieves, to the extent
possible, the original objectives and intent of Baptist WebSite
as reflected in the original provision.
22. This Agreement and all rights hereunder shall
be governed by the laws of the State of CONNECTICUT. Baptist
WebSite is a division of Anchor Webhost LLC. Any action relating
to this Agreement or to your use of the Baptist WebSite site
shall be brought exclusively in the courts of Connecticut in the
USA.
23. Baptist WebSite reserves the right to change
the Acceptable Use Policy without prior notice or warning.
Non-enforcement of any part of the Acceptable Use Policy does
not constitute consent.
24. This Agreement, the Baptist WebSite fee
schedule, the hosting terms of use and the Dispute Policy,
together with all amendments or modifications to any of them,
constitute the complete and exclusive agreement between you and
Baptist WebSite, and supersede and govern all prior proposals,
agreements, or other communications.
25. All Sub-Networks and distributive hosting
sites of Baptist WebSite must adhere to the above policies.
26. Complaints regarding Illegal Use or System or
Network Security issues and complaints regarding email abuse or
SPAM should be sent to abuse@baptistwebsite.com
27. Failure to follow any term or condition will
be grounds for immediate shut down.

character of the use, (2) the nature of the copyrighted work,
(3) the amount and substantiality of the portion used in
relation to the copyrighted work has a whole, and (4) the effect

uploading and downloading copyrighted sound recordings without
permission constitutes the "fair use."
